This is an agreement between you and Bin Buddy LLC (and its affiliates, “Bin Buddy” or “we”). Before using Bin Buddy, please read these Bin Buddy Terms and Conditions of Service, the Bin Buddy Privacy Notice, the Bin Buddy Recurring Payment Terms and Conditions, and any other applicable rules, policies, and terms posted on the Bin Buddy website (collectively, this “Agreement”). By using Bin Buddy, you agree to be bound by the terms of this Agreement. If you do not accept these terms, you may not use Bin Buddy.
By creating an account, accessing, or using our platform, you enter into a direct contractual relationship with Bin Buddy, a technology services provider that facilitates the connection between individuals, homeowners, vacation rentals, and property managers seeking waste management services and independent third-party providers of such services (“Bin Runners”).
You acknowledge and agree that Bin Buddy does not provide home services itself and is not a home contractor of any sort. All services are provided by independent third-party contractors who are not employed by Bin Buddy. We act solely as an intermediary by offering a platform through which individuals, homeowners, vacation rentals, and property managers can arrange and schedule services with Bin Runners.
Your use of the platform constitutes your agreement to be bound by these Terms and Conditions, which establish a contractual relationship between you and Bin Buddy. If you do not agree to these terms, you may not access or use the platform or services.
Definitions
“Bin Buddy” means Bin Buddy’s bin management service, including the Bin Buddy app and related services.
“Software” means all software (including updates or new versions), and any related documentation, that we make available to you for use in connection with Bin Buddy.
“Bin Runners” means persons employed or contracted by Bin Buddy LLC to provide Bin Buddy’s bin management service.
Home Access
By submitting your service subscription request online, you authorize Bin Buddy and its Bin Runners to access your property (or other designated location) for the purpose of taking out and returning your waste and recycling bins. By subscribing to our service, you confirm that you have the right to authorize Bin Buddy and its Bin Runners to access the designated property. It is your responsibility to ensure that Bin Buddy or its Bin Runners have full access to your bins on scheduled service dates. If Bin Buddy or its Bin Runners are unable to provide service due to lack of access, you will not be entitled to a credit or refund.
Service
According to the monthly service plan you selected at signup, your assigned Bin Runner will transport your general waste and recycling bins to the curb on the day prior to your scheduled waste collection day. After collection, your Bin Runner will return the bins to their original designated storage location in a timely manner.
Bin Access
You must ensure Bin Buddy or its Bin Runners have access to your bins on the scheduled service day, including but not limited to: gate entry codes, lock combinations, security guard verification, and pets relocated from storage areas. If Bin Buddy or its Bin Runners are unable to access your bins for any reason, services will not be performed that week and we can not issue a credit or refund. Bin Buddy reserves the right to decline service for any reason. Accurate and complete information regarding the location of your bins and any necessary access instructions must be provided. Failure to supply this information may result in service issues. We cannot be held responsible for non-delivery of service in these circumstances.
Pricing
You agree to pay Bin Buddy the then-current monthly service fee associated with your selected service plan, plus any applicable sales taxes. All fees are due as per the billing terms at the time of purchase. Bin Buddy reserves the right to modify the pricing of any service plan at any time, at its sole discretion. Any pricing changes will be communicated to you in advance and take effect in the next billing cycle following such notice, unless otherwise stated.
Change in Price
Although Bin Buddy makes every effort to remain competitive and offer reasonable prices, some cost increases may be beyond our control. In the event of a price change, Bin Buddy will provide you with 2 months written notice. You may cancel at any time if you do not agree with the new price. If you do not cancel, you will be billed and charged the new recurring monthly service fee.
Billing
Service fees for your selected plan are billed in advance, whether monthly or quarterly. Billing recurs automatically on your chosen schedule to ensure continuous service. To cancel and prevent future billing, you must submit a cancellation request. All applicable local, state, and federal taxes will be added to your service fee.
Payment Terms
By accepting these terms, you enroll in the Bin Buddy Payment Plan and agree to the Bin Buddy Recurring Payment Terms and Conditions. You authorize Bin Buddy to bill and charge your specified Payment Method and Payment Account according to your selected Payment Plan.
Service fees are billed on a recurring basis (monthly, quarterly, every 6 months, or every 12 months), depending on your selected plan. Bin Buddy will automatically charge the full amount to your Payment Method each time your service renews, unless you cancel according to these terms.
Cancellation
You can cancel your subscription and service by submitting a cancellation request online at Bin Buddy Service Cancellation Page. Please refer to the specific terms below based on your subscription type.
Trial Period
A 14-day trial period begins upon account activation, providing complimentary access to our Bin-to-Street services. To avoid future charges, cancel your subscription during this trial period. If you do not cancel, your subscription will automatically convert to the paid plan you selected at signup at the end of the trial.
Monthly Payment Plans
To cancel your monthly subscription, provide at least 30 days advance notice before your next billing date. For example, if your subscription renews on June 1st, you must provide notice by May 2nd to avoid being charged for the next cycle.
Quarterly Payment Plans
To cancel your quarterly subscription, provide at least 30 days advance notice before your next billing date. If cancellation is received after the start of a new cycle, you are responsible for the full quarter’s payment and we can not issue a refund in this situation. Upon receipt of your notice, we will terminate your subscription at the end of the current billing cycle. No refund is given for unused portions, and you retain access until the end of the 30-day notice or the current quarter, whichever is later.
Consolidated Billing
For accounts using consolidated billing, invoices issued prior to your cancellation request will not be adjusted. No credits will be issued for properties removed after the renewal invoice has been generated. Please plan your cancellation accordingly.
Upon successful cancellation, you will receive a confirmation email. Please retain this as proof. Bin Buddy’s failure to enforce any cancellation fees or other terms does not constitute a waiver of our right to enforce them in the future.
Important: Our service is billed on monthly and quarterly cycles, and we do not provide partial credits or refunds for unused portions of a billing cycle.
Pets
The homeowner/resident is responsible for containing and restraining pets. For the safety of our Bin Runners, if an unrestrained pet is present and our Bin Runner determines it is unsafe to access the property, service will not be completed. If you are signed up for notifications, you will be informed via SMS or email if your property could not be serviced. Unfortunately we can not offer credits, refunds, or adjustments in such cases.
Vehicles
Bin Buddy will make every effort to place your bins carefully at the curb for city pick-up. If your vehicle or any other vehicles hit or knock over your bins, Bin Buddy is not responsible for any damage to the vehicle or bins.
Garage Access
You affirm that your garage will be safe and free from hazards. You must disable any alarms or security systems in your home. Neither Bin Buddy nor its affiliates are responsible for disarming or resetting alarms or security systems, nor for your failure to do so, or for any liabilities resulting from your security system being unarmed. By granting access to your garage for the purpose of servicing your bins and providing a garage code, you agree to:
- Assumption of Risk: You assume all risks associated with granting access.
- Limitations of Liability: Bin Buddy is not liable for:
- Any lost or missing items from the garage,
- Any damage to the garage door or opener,
- Any occurrences of the garage door being left open.
- Best Efforts Commitment: While Bin Buddy will make every effort to open and close the garage responsibly, we cannot be held liable for any issues arising from the access granted.
Safety Issues
The homeowner/resident is responsible for maintaining code compliance with the city on issues such as fencing, gates, backwash/waste lines, and all other applicable safety issues.
Overloading and Closed Lid
For the safety of our Bin Runners, bins must not be overloaded, and lids must be properly closed in accordance with city guidelines. Overloaded bins or those with open lids may not be serviced. No credits, refunds, or adjustments will be issued in such cases.
Overflowing Trash and Access
Bins must be easily accessible and not surrounded by overflowing trash that obstructs access. Our Bin Runners must have a clear path to roll bins to the curb and back. If overflowing trash or other obstructions prevent access, service will not be delivered and no credits, refunds, or adjustments will be issued. Inclement Weather
The safety of our Customers and Bin Runners is our highest priority. In the event of inclement weather, including but not limited to severe rain, ice, wind, or snow, we reserve the right to delay, reschedule, or cancel services without prior notice. No credits, refunds, or adjustments will be issued for services that cannot be delivered due to such weather-related conditions.
Road Closure Policy
In the event of road closures that prevent access to your property, we cannot be held responsible for non-delivery of service. We can’t offer credits, refunds, or adjustments will be issued in these circumstances.
Sanitary Bin Policy
To ensure the safety and well-being of our Bin Runners, if your bins are deemed excessively dirty or smelly, we reserve the right not to service your property. It is the customer’s responsibility to maintain bins in an acceptable sanitary condition. If you are signed up for notifications, you will be informed via SMS or email if your bins require cleaning. If the situation persists, your property will not be serviced until the issue is rectified. No credits, refunds, or adjustments will be issued in these cases.
Software and Telecommunication Issues
While we take every precaution to ensure reliable delivery of our services, we cannot be held responsible for non-delivery due to unforeseen software and telecommunication issues. Such occurrences are rare, but certain variables (including third-party applications, hardware, and cellular service) are beyond our control. In these cases, no credits, refunds, or adjustments will be issued. We will do everything within our power to resolve any such situations as swiftly as possible.
Holiday Trash Schedule Adjustments
During holiday periods, we will make every effort to adjust our services in response to changes in your property’s trash collection schedule. However, due to the unique observance of holidays by each city and inconsistencies in revised schedules, we cannot be held liable for missed pickups during these times. We can not offer credits, refunds, or adjustments for services missed due to holiday schedule changes.
